| Official Contest Rules
NO PURCHASE NECESSARY TO ENTER OR WIN. THE CONTEST IS OPEN TO LEGAL RESIDENTS OF THE UNITED STATES. Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Contest Rules. The registration for the Historic Deadwood SMS Blackjack ("Contest") begins March 8th, 2010. Prizes will be awarded monthly to chip leaders. Contest is hosted by the Deadwood Chamber of Commerce and Visitors Bureau - 767 Main Street Deadwood, SD 57732 ("Host") and the Office of South Dakota Tourism 711 E Wells Ave Pierre, SD 57501 (“Host”).
Eligibility: Contest is open to all natural persons age 21 and older who are legal residents of the United States for the duration of the Contest. Employees, officers and directors of Host, its parent companies, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, their immediate family members and persons living in their same household, are not eligible to participate in the Contest. Void where prohibited. All federal, state, and local laws and regulations apply.
How to Enter: No purchase necessary. Play SMS Blackjack by texting PLAY to 88188 or bypass the game and text VIP to 88188 to receive SMS alerts, offers, and notifications without playing the game. By playing SMS Blackjack, you are entered into the Historic Deadwood VIP Club. You will receive occasional coupons, special offers, advance concert announcements, and opportunities to win prizes from the Deadwood Chamber of Commerce and their members.
Start off with $250 in chips and play the SMS Blackjack game as many times as they’d like. If you lose your entire $250, you can reload your chips at any time. Reply R to 88188 to see the top three chip leaders at any time. Text STOP to be removed from the VIP Club list and stop the game. The Deadwood Chamber reserves the right to limit game play to 15 times per day.
Please note: Standard rate charges for text messages sent and received to your handset may apply, depending on your individual wireless pricing plan, in accordance with your wireless customer agreement. You are responsible for all applicable costs and taxes associated with sending and receiving all Contest-related SMS messages.
Host is not responsible for lost, late, misdirected, or non-delivered entries or for any miscommunication or technical failures as a result of contest participation. Upon receipt, entries become property of Host.
Entrants agree that the Host, its affiliates, directors, officers and agents are not liable for, and will be held harmless against, any and all claims to injury, loss or damage of any kind resulting directly or indirectly from participation in this contest or from acceptance or use of any prize.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS IN VIOLATION OF CRIMINAL AND CIVIL LAW. HOST RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
Prize: Will be determined by the Deadwood Chamber of Commerce and Visitor Center. Prizes may include, but are not limited to, apparel, lodging, coupons, gaming chips, and souvenirs.
Selection of Winner: Prize awards will be given to the Chip Leader at least one time per month. In the event of a tie, the Leader that has not won a prize within the past six months will be awarded the prize. All decisions are final and binding. Odds of winning will be determined by the number of participants. Winner will be notified at the time of the selection via text message and/or phone communication. The award will also be mailed to the winner unless winner requests otherwise. Winner will have seven (7) calendar days from text message and/or phone notification to accept the prize. Host is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify winner or for late, lost, misdirected, or unsuccessful efforts of winner to claim prize.
In the event the award includes travel and/or lodging, winner and winner's traveling companion(s) will be required to sign and return waivers of liability, indemnification and medical release. A parent or guardian will be required to sign a waiver of liability, indemnification and medical release for each traveling companion below the age of majority. If the selected winner cannot be contacted, is ineligible, fails to claim a prize, or fails to timely return the completed and executed declaration and releases as required, prize may be forfeited or an alternate winner selected. An unclaimed prize will become the property of the Host.
Winner: The Registration Name of the potential winner of the Historic Deadwood SMS Blackjack prizes may be publicly announced, at the Host’s sole discretion, in any media for the duration of the sweepstakes period, but the Host has no obligation to do so.
Any potential prize winner must show proof of eligibility in order to accept the prize. Host is not obligated to select, or publicly announce, any alternative prize winner. By entering the Contest, all entrants agree that their registration names may be announced publicly either after or prior to the Host’s notification to them that they are a potential prize winner and either after or prior to the Host’s determination of their eligibility for, or their acceptance of the prize. The Host reserves the right to disqualify any potential winner if such potential winner is determined to have been ineligible or unqualified, or has won for two or more consecutive months.
Entrants and winner are solely responsible for their own actions relating to this Contest, and the acceptance and/or use of the prize. By participating in this Contest, and/or by acceptance or use of the prize, all entrants and winners agree to release and hold harmless Host, sponsors and their parent, affiliates, subsidiaries, retailers, agencies, Contest sponsors and the respective officers, directors, employees and agents from and against any liability arising in connection with the Contest and/or use of the prize.
